General Aspects
1.1 The jobsto.work website, available to users at the address jobsto.work (together with all its subpages), is managed by: IT Work Maintenance SRL, a limited liability company headquartered at Str. Poenari Nr.2, Bucharest, Romania. The “Terms and Conditions of Website Use” is a legally binding contract, even if you are just browsing jobsto.work (“the Website”) without registering an account or contacting us. It is referred to as (“the Website” or “jobsto.work Platform”) and those who use the website for any purpose (“the User”) are bound by the terms.
1.2 Accessing and using the Website, including any page or section thereof or any Service provided through the jobsto.work Website, can only be done in accordance with this document, which includes the Privacy Policy and the Cookie Policy.
1.3 Please note that we may revise the above-mentioned documents whenever we deem necessary, sometimes without prior notice. If you continue to visit our site after we have posted the revised versions, this means you accept the changes. If you do not agree with any changes, you must leave the Website.
1.4 When registering and creating a user account to use the services, we will ask the user to expressly agree to these terms and conditions by a specific action signifying unequivocal consent (e.g., checking the box “I HAVE READ AND AGREE WITH THE TERMS AND CONDITIONS of jobsto.work”).
1.5 By checking this box, the user:
- Expressly agrees to comply with all the clauses of this set of terms and conditions, as well as any other specific terms and conditions applicable to the services;
- Acknowledges the conditions for the processing of personal data in accordance with the privacy policy, which is an integral part of this set of terms and conditions.
1.6 To ensure compliance with the terms of access and use of the Services, all Users must check the jobsto.work Website Terms and Conditions each time they access the Website.
1.7 Even if you fail to review the Terms and Conditions but still use the jobsto.work Platform as a User (including as a Recruiter User or Candidate User), we will consider that you have accepted this set of Terms and Conditions (including any updates), unless during the relevant reference period your use is governed by specific rules expressly communicated to you (e.g., use during the notice period for the entry into force of any updates, if applicable).
1.8 If you do not agree with the provisions of this set of Terms and Conditions (including any updates), please do not use or, as the case may be, cease using the jobsto.work Website or the Services provided by Us.
2. Services of jobsto.work
The services offered through the jobsto.work Platform are aimed at (i) individual users who visit the Platform, (ii) users searching for a job (“Candidate Users”), and (iii) legal entities or authorized natural persons who want to post job advertisements or search for Candidate Users for specific jobs (“Recruiter Users”).
2.1. Creating a User Account, Passwords, and Responsibilities
Candidate Users can use certain features offered by the jobsto.work Website even without a User account.
To benefit from all the Services offered by the jobsto.work Website, Users (whether Candidate Users or Recruiter Users) must create an account on the jobsto.work Platform by filling out the forms available in the “NEW ACCOUNT” section.
For Candidate Users, the User account can also be created through a Google user account, in which case jobsto.work will retrieve certain public data associated with the User’s Gmail account.
After completing the account creation process, the User will receive the necessary codes for verification and validation of the contact details and the newly created account via the email address and phone number provided during the registration process.
To use the Services offered by the jobsto.work Platform, it is necessary to:
A. Provide true, accurate, and complete information about yourself by filling in the fields of the registration form for creating a User account;
B. Update the registration data when necessary, ensuring that they are always true, accurate, and complete. You agree to make such updates within 30 days of any changes.
For Recruiter Users, jobsto.work will verify the accuracy of the tax code and company details by accessing various public websites where their validity can be checked (depending on the country of origin of each company). Legal entities – Recruiter Users are required to provide accurate information regarding the name, email address, phone number, contact person’s first and last name, tax code, and special registration code in the case of recruitment agencies. Legal entities – Recruiter Users with active accounts on jobsto.work must be fiscally active (thus, Recruiter Users’ companies cannot be deregistered, suspended, or liquidated).
Companies recruiting for overseas positions must submit a copy of the Certificate of Registration issued by the Trade Registry with the business field relating to placement and recruitment of personnel.
Recruiter Users based abroad are required to enter a valid VAT number when registering on the Website and send a copy of the document confirming their tax registration in the country of residence.
If you provide information that is untrue, inaccurate, or incomplete, jobsto.work has the right to suspend or block your account and refuse all current or future attempts to use the jobsto.work Platform, in accordance with Sections 7, 8, and 9, as applicable, of these Terms and Conditions and within the limits of the law.
In case of incorrect information or fraud attempts by Recruiter Users (including attempts to obtain free advertisements or special offers granted by jobsto.work during marketing campaigns), jobsto.work reserves the right, at any time during the contractual relationship, to revoke the free offers or terminate the contractual relationship without any additional responsibility towards the Recruiter Users found at fault, in accordance with Sections 7, 8, and 9, as applicable, of these Terms and Conditions and within the limits of the law.
jobsto.work is NOT obliged to pre-screen the materials posted by Users. jobsto.work is not responsible, within the limits of the law, for the information and data posted, broadcast, or transmitted by its Users.
If requested by a User or if signs of potential fraud are discovered, jobsto.work may investigate and verify the claims and may decide whether the respective information should be removed in accordance with the law and these Terms and Conditions.
2.2. Candidate Users
Candidate Users can create a User account only if, at the time of account creation, they are at least 16 years old. Accessing the jobsto.work Platform and using the Services is not permitted for individuals under 16 years of age.
jobsto.work is an online recruitment platform that allows you to create a CV in our database.
As part of the Services offered, if requested by you (by email or phone), we can provide assistance through our consultants. With your express consent, one of our consultants will be able to create a User account for you on jobsto.work (if you do not already have one), write your CV within your User account, and, if you wish, apply to suitable jobs with your CV, each being presented to you for prior approval. You can edit the information published in your User account at any time.
The CVs uploaded to the jobsto.work Platform, as well as your contact details, may then be made available to Recruiter Users for recruitment purposes. In this respect, Candidate Users have three options:
- You can register your CV in our database. Upon registering the User account, your CV details will automatically be set as public to Recruiter Users only. Your CV will be visible to Recruiter Users who have purchased access to it and to Recruiter Users whose job ads you have applied to or will apply to.
- Recruiter Users who have access to the jobsto.work Platform database will be able to access your CV. If they wish, they can request to unlock your contact details, and you may be contacted for an interview or job offer.
- Your contact details (name, email, phone number, address) entered on jobsto.work will not be visible to search engines. Recruiter Users accessing your CV will only see your contact details if they have created a User account on the jobsto.work Platform, posted a job ad to which you have applied, or purchased your CV.
We strive to limit access to our database to employers, human resource companies, HR managers, and specialists, but we cannot guarantee that other third parties will not gain access to our database. jobsto.work does not assume responsibility for the use of CVs by third parties who have accessed them while in our database.
You can choose to hide or delete your User account. If you hide your CV from the database or delete your User account, Recruiter Users will no longer have access to your information.
However, as part of the Services provided by the jobsto.work Platform, Recruiter Users who have accessed the CV database can download or transmit the information available in the jobsto.work Platform onto their own storage media. In this case, even if we delete your data from our database, Recruiter Users may still have access to your data if they have downloaded, copied, or extracted it from the jobsto.work Platform. As independent operators, Recruiter Users are solely responsible for how they use the data they access through the jobsto.work Platform.
Some companies that have chosen to post their recruitment ads through the jobsto.work Platform may present misleading, incomplete, incorrect, or aggressively targeted information towards certain social categories. These rules impose fairness on employers, but not all Recruiter Users choose to follow them. You should therefore exercise caution before using the information contained in these ads, attending interviews, or making investments or any other actions involving your own or third-party resources. Please contact us if you come across such ads through our electronic Illegal Content Notification Form, as per Sections 3 of these Terms and Conditions, or for any other reports and reasons to contact us as outlined in Section 3.13 of these Terms and Conditions.
Please be aware that your contact details (name, email, phone, address) entered on jobsto.work will be made available to Recruiter Users as part of the recruitment process. By accepting these Terms and Conditions, you agree to receive SMS messages as part of the application/recruitment process.
2.3. Recruiter Users
jobsto.work ensures password-protected access to the User account created on the jobsto.work Platform. Through jobsto.work, Recruiter Users can search for and select Candidate Users for recruitment purposes.
2.3.1. How to Publish Recruitment Ads (Jobs) on the jobsto.work Platform
Job ads can be displayed on the jobsto.work Platform for a set period of time. Depending on the purchased ad (or received for free as part of a campaign), it can be valid for 30 days with the option of extension. After your ad is posted, it is sent via email to all Candidate Users who match the job profile and are subscribed to such notifications. Once the job profile in the ad is validated for publication (the Recruiter User has clicked on the “publish ad” button), it can no longer be modified after the ad has been displayed on the jobsto.work Platform and/or sent to Candidate Users. Any changes thereafter can be made directly by the Recruiter User or by a jobsto.work consultant, but only with the Recruiter User’s consent.
To publish a job, you must choose the type of job you want from the visible online packages (BASIC, STANDARD, and PREMIUM), click on it, and make the payment online through PayPal or STRIPE. After payment, your ad will be visible to users. Additionally, you can place an order with jobsto.work representatives for at least one ad and confirm the payment of the proforma invoice. Once we receive the payment confirmation, you will be able to immediately publish the desired job. jobsto.work representatives reserve the right to moderate the ad or take any restrictive action in accordance with the law and these Terms and Conditions.
2.3.2. “Free Ads” Policy and Special Discounts
jobsto.work may, at its discretion, offer free credits for posting job ads on the jobsto.work Platform or special discounts on its products and services. These offers are available only to Recruiter Users registered for the first time on the jobsto.work Platform who have correctly and fully completed their registration data, as long as there are no suspicions of system fraud. For example, if the registration occurs while jobsto.work offers free trial services, those services will only be valid for the first registration of a company/group of companies/contact person and not for subsequent registrations of related accounts. jobsto.work reserves the right to refuse the granting of such free ads if an identity is found to be linked to a company that has already benefited from such an offer.
Following an internal analysis of newly registered Recruiter Users on the jobsto.work Platform, we reserve the right to refuse granting free credits or special discounts.
Free ads may have the same validity period as paid ads and can only be posted on behalf of the registered Recruiter User on the jobsto.work Platform.
We also reserve the right to refuse publication or censor ads that are illegal, immoral, or contain offensive language, in compliance with the law and these Terms and Conditions. For example, we reserve the right to moderate or apply any restrictive measures to ads related to webcam operators, erotic massages, or similar services.
By agreeing to these terms, you also agree to adhere to the principle of good faith when drafting and publishing recruitment ads. You therefore undertake not to post incomplete, incorrect, or discriminatory ads and not to condition the subsequent selection of Candidate Users except based on the rules presented in the published job ad and in compliance with applicable legislation. You also agree to comply with all conditions and limitations mentioned in Section 2.4 of these Terms and Conditions.
If you fail to comply with these rules, you understand and agree that jobsto.work has the right to restrict your access to its Services in accordance with Sections 7, 8, and 9, as applicable, of these Terms and Conditions. In case of restriction for Recruiter Users who have paid for services, they will have the right to request a refund for the corresponding portion of the fee for the restricted period.
jobsto.work may also choose to offer “free ads” to already registered Recruiter Users or special discounts as part of certain marketing campaigns. The conditions and details of these free offers or discounts will be communicated as part of each campaign.
2.3.3. Searching CVs in the CV Database on the jobsto.work Platform
Choose one of the pricing packages corresponding to the number of CVs you can view in the jobsto.work Platform database. Pay for the Service. You can search through all CVs in our database, and depending on the chosen package (BASIC CV pack, POWER CV pack, and SUPER CV pack), you can view the contact details of a certain number of CVs.
In all cases, you understand and agree that you will only use the data contained in Candidate Users’ CVs for the sole purpose of recruitment.
Some candidates who have chosen to enter their CVs into the jobsto.work Platform database may present misleading, incomplete, incorrect, or aggressively targeted information towards other social categories. Therefore, you should exercise caution before using the information contained in these CVs, making any hiring decisions, investments, or other actions involving your own or third-party resources. Please contact us if you come across such CVs at [email protected], naming the email “Illegal Content Notification” in accordance with Sections 3.4 – 3.5 of these Terms and Conditions, or for any other reports and reasons to contact us as outlined in Section 3.13 of these Terms and Conditions.
2.3.4. Payment for Job/CV Packages and Other Transactions
Access to Services provided to Recruiter Users may be permitted only after payment. All payments and applicable fees may be made online via card payment, based on a proforma invoice, or at your request via a fiscal invoice, to the account indicated by jobsto.work in euros. All prices listed on the jobsto.work Platform are expressed in euros and do not include VAT. For payments made from Romania, the proforma invoice will include the EUR/RON exchange rate and the applicable VAT. At present, Recruiter Users representing foreign companies can only purchase jobsto.work services and products through online card payment. Access to some of the Services will not be granted until the transfer of funds to jobsto.work’s account is confirmed.
The jobsto.work Platform may also be used by some of its business partners as a basis for selling or promoting certain products and services. In this situation, the contract governing the relationship between you and the respective product and service provider will be concluded between you and the respective provider, not between you and jobsto.work.
If you wish to terminate the provision of the service to you, you understand and agree that already made payments are non-refundable.
Services provided by jobsto.work are based on a certain number of ads or CVs with contact details. jobsto.work may change the established price for providing the service, as well as any other clause of these Terms and Conditions, upon the expiration of the initial contract period.
You agree and acknowledge that purchased services must be used within a maximum of 24 months from the date of the fiscal invoice. Unused services will expire and be deleted from the Recruiter User’s account after 24 months from the invoice date. In addition, by using the services, you accept and agree that you will have access to saved CVs in the account, either through candidates applying to your ads or by manually unlocking them from the jobsto.work database, only for a limited period of time. To protect Candidate Users’ personal data, jobsto.work reserves the right to remove CVs older than 12 months from storage without prior notice to Recruiter Users.
You agree and acknowledge that any delay in payment of amounts to jobsto.work will constitute a violation of these Terms and Conditions. In the event that jobsto.work reserves the right to take any further legal or contractual actions, you agree and acknowledge to reimburse jobsto.work for all costs and expenses incurred in recovering or attempting to recover these unpaid amounts.
You also agree that publishing an ad on the jobsto.work Platform before making payment to jobsto.work is equivalent to entering into a contractual relationship with jobsto.work, giving rise to the equivalent payment obligation unless the ad was granted for free as part of a marketing campaign.
After the agreed payment deadline, as stated in the proforma invoice, jobsto.work is entitled to restrict access to the Platform until payment is made. Non-payment may result in the calculation of late payment penalties amounting to 0.1% per day of delay, calculated until the full payment is made.
This does not affect the ads that will remain active: candidates will still be able to apply to the company’s active ads, and you will have access to their CVs after payment is made.
2.3.5. Access to the Recruiter User Account for Other Persons within the Same Organization
The account associated with a Recruiter User allows the setting of access for other persons (e.g., employees, collaborators) to receive notifications sent by the Company to the Recruiter User account. The Recruiter User is responsible for collecting personal data from these individuals, particularly for informing and obtaining consent (or identifying another legitimate basis) for sending personal data to the Company, used for such communications.
2.4. Publishing CVs / Job Ads through the jobsto.work Platform. Conditions for User-Published Content
The jobsto.work Platform is a communication platform between Users, with the Users being responsible for the content of the information they provide and store on behalf of the Users, and which is published on the jobsto.work Platform (CVs, Job Ads, etc.), hereafter referred to as “User-Published Content.”
The User is solely responsible for the User-Published Content. You should be aware that posting and sending messages through the jobsto.work Platform is subject to the following conditions and limitations:
- The published ads must be complete, containing all the information or conditions related to the respective ad. One ad corresponds to one job position but can refer to multiple roles if the recruiter is looking to hire more individuals for the same role.
- You may not post, transmit, or refer to any type of message that may contain a form of “advertisement” commonly recognized in society for various categories of goods and services.
- You may not post, transmit, or recommend unsolicited commercial messages to Users, regardless of whether this sending is done through the communication systems provided by jobsto.work or through other communication means but using data obtained through the jobsto.work Platform.
- You may not post, transmit, or refer to messages that contain recommendations to buy or not to buy a particular product or service, except in legitimate cases where courses necessary for employment are mentioned. Similarly, you may not post or refer to messages that contain confidential information, regardless of whether it is marked “confidential” or has any similar mention, or to messages that aim to affect the price, image, or market value of a product or service.
- You may not post, transmit, or refer to messages that contain illegal, threatening, abusive, indecent, or discriminatory texts, or that violate the rights of third parties or legal provisions in any way.
- You may not post, transmit, or refer to messages that contain viruses or any other code that proves to be destructive or that may interrupt, eliminate, or limit the functionality of the jobsto.work Platform or any other IT systems (hardware or software).
- You may not collect personal information from jobsto.work users or members for purposes other than accessing the Services provided by jobsto.work (i.e., applying to a job ad published by a Recruiter User or contacting Candidate Users during the recruitment process).
- You may not restrict or remove other Users’ access to the communication platforms provided by jobsto.work.
- You may not post, transmit, or refer to messages where the source is hidden.
- You may not post, transmit, or refer to any form of “pyramid scheme” or any other activity designed to deceive people, as well as any activities similar to actions that have been proven in the past to have criminal potential or the potential to deceive the trust of a jobsto.work Service User.
- You may not provide erroneous information, non-compliant with reality, inaccurate, or incomplete.
- You may not engage in attempts to defraud Recruiter Users (including attempts to obtain free ads or special offers provided by jobsto.work as part of marketing campaigns).
- You may not present a misleading, incomplete, incorrect reality, or aggressively target other social categories.
- You may not post job ads for webcam operators, erotic massages, or other similar services unless pre-approved by a jobsto.work representative.
- You may not post ads contrary to good morals or containing offensive language.
- You may not post incorrect or discriminatory ads, and you may not condition the selection of Candidate Users except based on the rules presented in the published job ad and in compliance with applicable legislation.
You may not publish materials that violate any other provisions of these Terms and Conditions; jobsto.work may remove them from the Platform in compliance with the law and according to these Terms and Conditions.
By posting User-Published Content on or through the jobsto.work Platform, you agree that you are solely responsible and will indemnify jobsto.work for any damages, costs, or lost profits resulting from your posting, transmitting, or referring to messages that violate the conditions and limitations described above.
Some Users may find it easier to violate the rules outlined in this set of Terms and Conditions, and as a result, some of the messages posted may present a misleading, incomplete, incorrect, or aggressively targeted reality. Therefore, you should exercise caution before using the information contained in these messages for any investments or actions involving your own or third-party resources. The image presented by the posted messages may sometimes differ from reality.
3. Content Moderation and Illegal Content Notifications
jobsto.work has no general obligation to monitor User-Published Content or to actively search for facts or circumstances that indicate illegal activity or incompatibility of User-Published Content with third-party rights, these Terms and Conditions, or other legal provisions. However, jobsto.work reserves the right to conduct voluntary investigations on its own initiative to detect, identify, and remove or disable access to illegal or incompatible User-Published Content and take any necessary measures in accordance with the law and/or these Terms and Conditions.
jobsto.work does not guarantee the content of the Ads, including those verified by its representatives, and the provisions of Sections 7 – 10 of these Terms and Conditions remain fully applicable.
The User agrees to cooperate and assist jobsto.work in good faith, provide the requested information, and undertake reasonably requested actions regarding any investigation conducted by jobsto.work concerning User-Published Content on the Website or its use, including following the transmission of an Illegal Content Notification.
jobsto.work provides means for Users and third parties, including trusted flaggers designated under Article 22 of the Digital Services Act (DSA) (Regulation (EU) 2022/2065 on a single market for digital services and amending Directive 2000/31/EC), to notify jobsto.work of alleged illegal content directly through the jobsto.work Website by using the email [email protected].
To the extent possible, the person submitting the report must provide all necessary data to help jobsto.work identify the illegal content, considering the provisions of Article 16(2) of the DSA, including:
- A sufficiently justified explanation of the reasons why the reporting person believes the information constitutes illegal content;
- The exact URL(s) of the content or, if necessary, additional information to help identify the illegal content;
- The name and email address of the reporting person (according to the instructions in the form);
- A statement confirming that the reporting person has a good-faith belief that the information and claims contained in the notification are accurate and complete.
If the illegal content report is not fully or properly completed, jobsto.work may be unable to identify the alleged illegal content or take action based on the received notification. For example, for certain types of notified information (e.g., intellectual property violations), without the identity of the reporting person, it is likely that determining whether the information constitutes illegal content will not be possible.
jobsto.work will confirm receipt of the Illegal Content Notification at the email address provided above. If electronic contact details of the reporting person are not provided, jobsto.work will not be able to send a confirmation of receipt.
jobsto.work will make decisions regarding the information referenced in the notifications in a timely manner, with diligence, objectively, and without arbitrariness.
jobsto.work will notify the individual or entity concerned of the decision regarding the information referenced in the notification, providing information on possible remedies regarding the decision, in accordance with the law.
jobsto.work may request additional information and data from the person who submitted the Illegal Content Notification, to the extent necessary for processing the notification, if the reporting person provided contact details.
As part of its investigations or analysis of Illegal Content Notifications or other reports, jobsto.work uses various processes and tools to identify, review, and moderate User-Published Content. This may include human review, automated review, or a combination of both. If automated means are used for processing Illegal Content Notifications or for making decisions regarding such notifications, jobsto.work will inform the User of the use of automated means in the decision, or in other situations as provided by law.
jobsto.work suspends the processing of Illegal Content Notifications that are clearly unfounded, in accordance with Section 9 of these Terms and Conditions.
The person who submitted the notification has the right to file a complaint regarding decisions made by jobsto.work concerning the notification, in accordance with Section 8 of these Terms and Conditions.
For all other reports that do not fall under this Section 3 or the requirements imposed by the DSA, Users can contact jobsto.work through the contact form or by phone available in the Contact section of the Website.
4. Protection of the User Account (Candidate User or Recruiter User)
Access to your User account on the jobsto.work Platform is protected by a password. We recommend that you do not disclose this password to anyone. jobsto.work will never ask for your account password in unsolicited messages or phone calls. Furthermore, we recommend that you log out of your User account (i.e., “Sign out”) at the end of each session. We also advise you to close the browser window you worked on at the end of your navigation on jobsto.work.
These tips are intended to help you avoid unauthorized access to your personal information or correspondence.
You are responsible for maintaining the confidentiality of your information and password. You are responsible for all uses of your registration, whether or not authorized by you. You agree to notify jobsto.work regarding any unauthorized access to your data used for logging into the jobsto.work Platform. jobsto.work is not liable for any moral or material damage caused by your failure to comply with the security measures related to accessing the jobsto.work platform.
5. Protection of Intellectual Property
The content and design of the jobsto.work Platform (as well as any other material related to jobsto.work) sent to you via email or provided to you in any other manner (for example: articles, designs, newsletters, and any other materials, hereinafter referred to as “jobsto.work Content”) belong to jobsto.work and its collaborators, regardless of whether the author is specified or not, and are protected by intellectual property laws. Articles published on the jobsto.work Platform may not be produced by jobsto.work; in this case, the intellectual property rights associated with those articles belong exclusively to jobsto.work’s collaborators who created them.
You may not use, reproduce, or allow anyone to use or reproduce these materials without written permission from jobsto.work or its collaborators who hold the intellectual property rights to that portion of the content on the jobsto.work Platform. Similarly, reproducing any of the information contained in Candidate CVs or Company job ads is prohibited without the prior written consent of jobsto.work.
You may use the content of the jobsto.work Platform only for your own and your company’s use, in line with the purpose for which you registered on the Platform. Except as mentioned above, the content of the jobsto.work Platform may not be reproduced, modified, or exploited, whether for commercial or non-commercial purposes.
The following actions are prohibited without obtaining prior written permission from jobsto.work:
- 5.1. Reproducing or storing the content, as well as transmitting it to any other website, server, or any other information storage means.
- 5.2. Modifying, publishing, transmitting, and participating in the transfer, sale, or distribution of materials created through the reproduction, modification, or display of the content without prior written permission from us.
- 5.3. Removing marks that signify/intellectual property rights ownership by jobsto.work from the content.
Any use of the jobsto.work platform content for purposes other than those expressly permitted by this document is prohibited. Requests to use the content for purposes other than those expressly permitted by this document can be sent to: [email protected].
Additionally, using automated means such as scripts, bots, spiders, crawlers, and/or other computer applications/programs that may deceive or simulate certain activities or statuses on the jobsto.work Platform, or that exploit certain features or vulnerabilities to gain advantages for yourself, other Users, or third parties is prohibited.
6. Protection of Personal Data
jobsto.work treats the confidentiality of Users’ personal data seriously. The Privacy Policy and details regarding how jobsto.work processes Users’ personal data (including the representatives of Recruiter Users) are described in the Privacy Policy section.
Moreover, Recruiter Users act as personal data controllers in accordance with applicable law, and as such, they have a series of corresponding rights and obligations regarding the personal data of Candidate Users accessed through the jobsto.work Platform.
When using the services provided through the jobsto.work Platform, Recruiter Users agree and acknowledge that they are bound by the terms and conditions of the Data Processing Agreement, which forms an integral part of this set of terms and conditions. When a Recruiter User account is created, the terms and conditions will include the Data Processing Agreement as an annex, which will then be available in the User account.
Additionally, Recruiter Users located in third countries that do not offer an adequate level of protection can only access Candidate Users’ personal data based on a set of Standard Contractual Clauses approved by the European Commission for data transfers to third countries. The Data Processing Agreement will include such clauses, and Recruiter Users will need to accept them before accessing Candidate Users’ data.
Without the signed Standard Contractual Clauses with the Recruiter User, transfers can only be made on the basis of other mechanisms that provide adequate guarantees in accordance with Article 46 of the GDPR, or if the transfer is necessary for the execution of a contract with the data subject (e.g., when a Candidate User directly applies for a job posted by a Recruiter User in a third country).
7. Modifications, Restrictions, and Suspension of Access
7.1. jobsto.work reserves the right to suspend, modify, add, or delete any portions of the jobsto.work platform content at any time.
7.2. Additionally, based on voluntary investigations or following Illegal Content Notifications or other reports, jobsto.work may take further investigative actions or restrictive measures regarding User-Published Content, as outlined in these Terms and Conditions.
7.3. jobsto.work may conduct verification actions to determine the circumstances of a case, acting in a proportional and reasonable manner, including, for example, by contacting the person who reported the content, the author of the User-Published Content (if jobsto.work knows their contact details), the competent authority, or an external consultant.
7.4. Depending on the severity of the alleged violation, jobsto.work may immediately deactivate the respective content, particularly the Ad or CV, along with all promotion services associated with it. Once deactivated, the content will no longer be visible or available to those using the Website.
7.5. jobsto.work may immediately take any restrictive measures concerning illegal User-Published Content upon receiving an order to this effect from the competent authorities, in accordance with Article 9 of the DSA. In such a case, if jobsto.work has the relevant contact details, it will inform the responsible User, in accordance with the law, of the received order, the reasons for the decision, available legal remedies, and a description of the territorial scope of the respective order.
7.6. In the event of a violation of legal provisions or the Terms and Conditions of Website Use by Users, jobsto.work reserves the right to take, at its chosen time (unless a specific deadline is legally required for restriction under the law or these Terms and Conditions), and depending on the severity of the violation, the following restrictive measures:
- Refusal to publish or censor the non-compliant User-Published Content.
- Deleting certain non-compliant elements of User-Published Content.
- Permanently deactivating Ads.
- Restricting User access to one of its communication platforms.
- Restricting User access to part or all of the Website’s content. In this sense, jobsto.work may block access to services or use of its other services from which the User benefits.
- Suspending or blocking your account.
- Refusing current or future attempts to use the jobsto.work Platform.
- Revoking free offers.
- Terminating the contractual relationship (in cases such as repeatedly posting illegal content, posting misleading job ads that do not represent a real job offer, or requesting abusive payment from candidates).
7.7. jobsto.work may suspend the provision of Services to Users who frequently provide clearly illegal User-Published Content, in accordance with Section 9 of these Terms and Conditions.
7.8. jobsto.work may block a Recruiter User’s access to their account indefinitely if they have repeatedly posted illegal content or misleading job ads that do not represent a real job offer, or if jobsto.work has repeatedly applied suspension, as outlined in Section 9 of these Terms and Conditions.
8. Internal Complaint Resolution System
Users and individuals who have submitted a notification have the right to file a complaint regarding decisions made by jobsto.work concerning the received notification or concerning decisions to restrict content that is illegal or incompatible with these Terms and Conditions.
Complaints may be filed within six months from the date the decision to restrict access was received by the User in question or from the date the notifier was informed of the decision made by jobsto.work regarding the submitted notification.
The complaint may be filed through the internal complaint resolution system of jobsto.work by sending it electronically to [email protected], following the instructions provided in the decision or reasoning provided by jobsto.work.
jobsto.work suspends the processing of complaints from Users and notifiers in accordance with Section 9 below.
If the complainant has not provided jobsto.work with all the necessary information to identify and resolve the complaint, jobsto.work may notify the complainant of the missing information and allow them time to clarify/comply.
jobsto.work handles complaints submitted through the internal complaint resolution system diligently, objectively, and without discrimination, in accordance with Article 20 of the DSA.
Complaints will be reviewed, and a response will be provided within a reasonable timeframe established by jobsto.work based on the situation.
jobsto.work may cancel the restriction decision or act on the received notification if it finds the complaint to be valid, in accordance with Article 20(4) of the DSA.
If the complainant is not satisfied with jobsto.work’s response to the complaint, they have the right to select an out-of-court dispute resolution body certified under Article 21 of the DSA to resolve disputes related to the respective measures, including unresolved complaints through our complaint management system. jobsto.work and the complainant will collaborate in good faith with the selected dispute resolution body to resolve the dispute. jobsto.work reserves the right to refuse to cooperate with the dispute resolution body if a dispute concerning the same content and the reasons for the alleged illegality or non-compliance with these Terms and Conditions has already been resolved or is already the subject of an ongoing procedure before a competent court or another out-of-court dispute resolution body.
Nothing in these Terms and Conditions affects the right to an effective remedy before a court of law.
9. Abusive Use Policy
jobsto.work suspends the provision of Services for a reasonable period of time to Recruiter Users who frequently provide content that is clearly illegal. jobsto.work will consider content to be clearly illegal if it is evident to a non-specialist, without requiring any detailed analysis, that the content is illegal. jobsto.work will issue a warning before such suspension.
When deciding on such a suspension, jobsto.work will consider all the relevant facts and circumstances from the information available to it, including (a) the absolute number of clearly illegal content items submitted over a certain period of time; (b) the relative proportion of this number to the total amount of content provided over a certain period of time; (c) the severity of the abuses, including the nature of the illegal content and its consequences; (d) the intent of the User who provided the illegal content, insofar as it can be determined by jobsto.work.
jobsto.work may consider the following aggravating circumstances when deciding on such suspension:
- If the Recruiter User has a history of repeatedly providing content in violation of legal provisions.
- If the Recruiter User continues to provide illegal content despite previous warnings and measures applied by jobsto.work.
- If the illegal content involves violence, discrimination, fraud, or criminal activity.
- If the Recruiter User acted with the clear intent to spread illegal content.
- If the Recruiter User attempted to manipulate the Platform’s security measures to continue posting illegal content.
- If the Recruiter User’s behavior caused significant harm to other Users, put the Platform in a bad light, or created an unsafe or hostile environment for other Users.
jobsto.work may consider the following mitigating circumstances when deciding on such suspension:
- If the Recruiter User has a history of cooperating with jobsto.work, especially when receiving warnings, and/or providing legal content.
- If the Recruiter User took proactive measures to rectify previous violations.
jobsto.work suspends the processing of Illegal Content Notifications for a reasonable period of time if the notifier in question frequently submits clearly unfounded notifications. jobsto.work will issue a warning before such suspension. When deciding on such suspension, jobsto.work will consider all relevant facts and circumstances from the information available to it, including (i) the quantity, severity, and frequency of unfounded notifications; (ii) the ratio of unfounded notifications to all notifications submitted by the notifier; and (iii) the notifier’s intentions, insofar as they can be determined by jobsto.work.
jobsto.work suspends the processing of complaints from Users and notifiers for a reasonable period of time if they frequently file clearly unfounded complaints. jobsto.work will issue a warning before such suspension. When deciding on such suspension, jobsto.work will consider all relevant facts and circumstances from the information available to it, including (i) the quantity, severity, and frequency of unfounded complaints; (ii) the ratio of unfounded complaints to all complaints; and (iii) the intentions pursued by the User or notifier, insofar as they can be determined by jobsto.work.
jobsto.work will determine the suspension period on a case-by-case basis, depending on the specific circumstances of each case, for example:
- Minor violations: Temporary suspension for 10 days.
- Moderate violations: Temporary suspension for 20 days.
- Serious violations: Temporary suspension for 40 days.
10. No Warranty and Liability Disclaimer
Although we make every effort to ensure the quality and accuracy of the data published on the jobsto.work Platform, jobsto.work cannot guarantee that the information presented by Candidate Users in their CVs is correct, complete, and up-to-date, just as it cannot guarantee this in regard to the information presented by Recruiter Users in their job ads published on the Platform. To the extent permitted by applicable law, jobsto.work shall not be held liable in any case for any damages, whether direct or indirect, or for any loss of profit, whether direct or indirect (including but not limited to losses due to loss of profit, business interruptions, or other financial losses), suffered as a result of using, discontinuing use, or the lack of regularity of the information and services provided by jobsto.work.
jobsto.work does not guarantee the accuracy, correctness, or current relevance of the information or services provided by jobsto.work. Additionally, jobsto.work does not guarantee that the IT systems or programs used by jobsto.work to display or transmit information on the Platform or in any other form are free of viruses or other destructive code or harmful properties. However, we can guarantee that our team will always seek to provide the most up-to-date information and ensure the highest level of security for all users of the Platform.
To the extent permitted by applicable law, you agree to indemnify and hold jobsto.work harmless for any judicial or extrajudicial actions and to cover legal fees and any other costs that may arise as a result of your violation of these Terms and Conditions.
11. Recommendation Systems
jobsto.work uses recommendation systems to display information on the Site in a more relevant manner. To make it as easy as possible for you to find a suitable Ad, each filter and recommendation factor may be more or less important in different cases, depending on what we believe is most likely to produce a list of Ads you may want to view.
Ads posted on the Site are displayed to Users based on dedicated filters/criteria that allow the selection of sorting principles. The criteria and filters for displaying and sorting used on the Site allow:
- Displaying and sorting Ads based on a system that considers search criteria (keywords entered by the User in the Ad search field) and specific pre-established filters selected by the User (such as job type, industry, domain, education level, salary, city).
- Displaying and sorting Ads based on relevance (the default method for presenting User-Published Content).
- Displaying and sorting Ads by the date they were published on the Site, starting with the most recent date and moving toward the furthest in time.
- Displaying and sorting Ads based on proximity. Selecting this criterion allows Ads closest to the User performing the search to be displayed. To apply this criterion, we require the User’s permission for geolocation by selecting the explicit button on the page corresponding to this criterion.
Users are free to choose between the criteria for displaying Ads. If no criterion is selected, Ads will be displayed by the date they were added.
Users are free to select or not to select the pre-established filters available on the Ad search page, as well as to enter or not enter the desired keywords in the search field. Depending on the filters applied by the User to narrow down search results to specific Ad parameters, as well as the keywords or phrases searched, different parameters may increase or decrease the final matching score and the position of individual Ads in the search results.
12. Final Provisions
12.1. These Terms and Conditions represent the entire agreement between the parties concerning the subject matter hereof and supersede all prior agreements, understandings, and negotiations, whether oral or written.
12.2. If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
12.3. These Terms and Conditions are governed by the laws of Romania. Any disputes arising from these Terms and Conditions shall be subject to the exclusive jurisdiction of the Romanian courts.
12.4. The User agrees to comply with all applicable laws and regulations when using the jobsto.work Platform.
12.5. The User acknowledges that jobsto.work may, at its discretion, change these Terms and Conditions, and the User agrees to check these Terms and Conditions periodically for updates. Continued use of the jobsto.work Platform after changes to these Terms and Conditions shall constitute acceptance of those changes.
